JA provides new guidance on Burmese gem ban

New York--Jewelers of America (JA) has sent its members the latest changes to and updated guidance on the Tom Lantos Block Burmese JADE (Junta's Anti-Democratic Efforts) Act of 2008, which banned the importation of Burmese jadeite and rubies, effective Sept. 27, 2008.

According to a release issued by JA, the guidance includes the latest U.S. Customs and Border Protection rules on imports of non-Burmese rubies and jadeite. The agency issued its most recent update on March 18.

It includes the latest rules regarding certification and record-keeping requirements, as well as a list of the two exceptions in which the JADE Act does not apply.

The amendment is available in its entirety here on the U.S. Customs and Border Protection's Web site.

JA's guidance includes bullet points on "What You Need to Know" and "What You Need to Do," and offers specific information for retailers who are importing rubies and jadeite directly from overseas, as well as for those who are not importers.

Among JA's suggestions are:

Those who are not direct importers need to get assurance from their suppliers that they are sourcing non-Burmese rubies and jadeite in compliance with the U.S. Customs and Border Protection's strict import rules.

In addition, the guidance contains "Talking Points" to help jewelers answer consumer, press or human rights groups questions.

JA members also can use the Sample Policy Statement on the Burmese gem ban provided by JA, which they can cut and paste into their own letterhead to give to consumers, display in-store or post to their Web sites.

"An increasing number of socially conscious consumers, particularly younger ones, are asking questions about the products they buy, especially where and how they were sourced and manufactured," JA President and Chief Executive Officer Matthew A. Runci said in a media release. "Jewelers of America's 'Member Guidance on the Burma Gem Ban' helps jewelers understand their responsibility, so that the can, in confidence, answer questions."
