Azotic settles with one party in trademark case

St. Paul, Minn.—Azotic Coating and Star Ring have reached an out-of-court settlement in Azotic's lawsuit alleging trademark and patent infringement, the companies confirmed on Friday.

Azotic filed suit in April against Star Ring, ShopNBC and Serenity Technologies, alleging the companies infringed on Azotic's patented gemstone-enhancement process for its trademarked Mystic Topaz brand, according to court papers filed in the U.S. District Court of Minnesota.

Azotic President Ron Kearnes says he filed the suit in April after Star Ring began purchasing gemstones from Serenity that allegedly violated Azotic's trademark.

The parties did not disclose the full terms of the agreement, but say Star Ring will return to buying gemstones from Azotic.

"We hope to restore our relationship with them and start selling them a lot more gemstones," Kearnes says.

Kearnes says his lawyer is also in talks to settle the suit with ShopNBC.

Representatives from Serenity Technologies and ShopNBC did not immediately return calls for comment on this report.
