Tacori prevails in second copyright suit

Los Angeles--After being awarded $650,000 in damages from an Ohio ring company earlier this year, Tacori Enterprises is claiming another copyright victory, this time nailing the wholesale manufacturer of the rings that it accused of copying its signature design.

According to court documents filed in U.S. District Court for the Central District of California in Los Angeles, Judge Gary Allen Fees has awarded Tacori $1.18 million in damages and attorney's fees, entering a default judgment against Hong Kong wholesale manufacturer Beverlly Jewelry Company Ltd. The ruling stated that Tacori "has shown it is entitled to relief for copyright and trade dress infringement."

Tacori claimed in its suit that Beverlly Jewelry manufactured and sold rings that were "confusingly similar" to its own copyrighted ring designs and infringed the "Tacori Look" trade dress. The lawsuit includes Tacori's signature "crescent silhouette" designs and additional rings that mirror the same design, which Tacori refers to as the "Tacori Look," according to court documents.

The judge also issued a permanent injunction barring Beverlly from ever infringing on the Tacori copyright or aiding another company in doing so.

Beverlly was the same company cited in a suit filed by Tacori against Bucyrus, Ohio-based Rego Manufacturing.

In January, a judge presiding over that lawsuit in Cleveland awarded Tacori $650,000 in damages, ruling that Rego infringed upon Tacori's designs when it purchased and then sold Tacori-like rings from Beverlly.

"This is a victory not only for Tacori, but for our stores who carry our exclusive designs," said Paul Tacorian, senior vice president of marketing and sales for Tacori, in a press release issued on Thursday. "Tacori is committed to supporting our authorized retailers who legitimately carry Tacori designs, and we want to protect their investment in Tacori."

Court papers show that Tacori was awarded $832,245 in statutory and actual damages and $350,091 in attorneys' fees in its case against Beverlly.
