JA asks Congress to support sales tax changes

New York—Jewelers of America (JA) has signed and endorsed a letter asking members of Congress to pass the Sales Tax Fairness and Simplification Act.

The act, introduced in the Senate by Republican Sen. Mike Enzi of Wyoming, would permit states to require that remote retailers collect and remit sales and use taxes on catalog and Internet purchases.

The bill is designed to ensure remote retailers, such as Web sites, have to charge state and local taxes, just like retail stores do.

JA joins a group of 100 retailers and organizations in expressing support for the act, including the International Council of Shopping Centers, the National Conference of State Legislators, Wal-Mart and J.C. Penney.

"JA has been an advocate for sales tax fairness since the issue's inception in 2002, and we will continue our efforts until Congress takes action to level the playing field between traditional jewelry businesses and Internet-only jewelry retailers," JA President and Chief Executive Officer Matthew J. Runci said.

The letter, sent to Enzi and Democratic Rep. William J. Delahunt of Massachusetts, who introduced the companion bill in the House, states "brick-and-mortar retailers are required to collect state and local sales taxes, while many online and catalog retailers are not...This uneven and complex system imposes substantial costs on retailers and consumers and costs states and localities billions in lost revenue."

The Sales Tax Fairness and Simplification Act would work with the Streamlined Sales and Use Tax Agreement passed in 2002, which was implemented in 22 states and seeks to align the states' sales and use tax laws.

The Sales Tax Fairness and Simplification Act should not be confused with the recently enacted Internet Tax Moratorium extension. The Internet Tax Moratorium bans taxes such as Internet access taxes, rather than sales taxes.
